TERMS AND CONDITIONS

THE FOLLOWING TERMS AND CONDITIONS APPLY TO ALL EVENTS, CAMPS AND OTHER ACTIVITIES BOOKED FROM SPORTINC.BE, www.thinkfooture.be  and www.streethockey.be PLEASE ALSO NOTE SPECIAL CONDITIONS RELATING TO THE COVID 19 PANDEMIC

1.    BOOKING REGISTRATIONS AND PAYMENTS
All registrations for the different camps will exclusively be done via the internet site www.thinkfooture.be or www.streethockey.be

2.    CONFIRMATION
Your camp will be confirmed after we receive your booking form and the payment.  The participant gets acces tot the camp and activities after the price had been paid. The prices for the camp are listed on Sportinc website. Alle prices include taxes. An order can be revoked 14 das after placing the order by means of a dated e-mail (art. VI.45 WER). Revocation is no longer possible 14 days before the start of the camp.

3.    CANCELLATIONS PARTICIPANTS
If you wish to cancel the booking or any part thereof you must always notify us immediately in writing to info@sportinc.be. Until written confirmation is received we will continue to hold your reservation. All cancellations will be acknowledged.

3.1 Cancellation for injury or illness: The refund will only be made if a medical certificate is sent to info@sportinc.be
·       In the case of a cancellation due to injury or illness, not notified before the start of the camp, a flat-rate amount of 50€ (day camp) and 100€ (residential camp) will be withheld for the administrative costs and will be deducted from the refund.
In the case of a cancellation for injury or illness, not notified before the end of the camp, no refund will be made.

3.2 cancellation for a reason other than Injury or illness: The refund will only be made if a mail explaining the situation is sent to info@sportinc.be
In the case of a cancellation not due to injury or illness not notified before the start of the camp, a flat-rate amount of 50€ (day camp) and 100€ (residential camp) will be withheld for the administrative costs and will be deducted from the refund.
No – partial – refunds will be given in case of either delay or non-appearance on the part of the customer.

4. CANCELLATIONS ORGANISATION

4.1 Sportinc has the right to cancel any camp if there are not enough participants, at the latest 2 weeks before the start of the camp. If this happen Sportinc will refund 100% of the fees paid within 7 days.

4.2 If Sportinc is obligated to cancel the camp due to a force majeure.  Sportinc will refund 100% of the fees paid. Sportinc will not reimburse any other costs for the participants linked to the cancellation of a camp.

5. CANCELLATIONS COVID 19 OTHER DISEASES & VIRUSSES
In case of cancellation of the camp before or during the camp, due to measures linked to the covid 19 or an other disease, we will reimburse 100% of the fees paid.
If a participant cannot participate due to forced quarantine or covid 19 positive testing. The refund will only be made if a medical certificate is sent to info@sportinc.be.  We will reimburse 100% of the fees paid. Off course 😉

6. RESPONSIBILITY
We reserve the right to decline any subscription or exclude any child at any time prior to or during the camp or activity if in our reasonable opinion the behaviour of the child is disruptive, dangerous, annoying or incompatible (whether as a result of any illness, disability, social behavioural problem(s) or otherwise) with the general enjoyment of other participants. The customeer agrees that if we in our absolute discretion deem that any adjustments (whether made by Us and/or You and/or the party member(s) in question) are not reasonable and/or are reasonable but are likely to adversely impact (e.g. from a safety or any other similar perspective) on any other child) the camp or activity then Our decision to decline the subscription or exclude a child is final and shall not be open to legal challenge. Any additional costs so incurred shall be entirely the responsibility of the customer.
No refunds will be given in the case of exclusion.
The customer/parent(s) shall advise Us at the time of booking and immediately after subscription fully in writing of Your child’s name contact details and any requirements needs or personal/medical circumstances that the customer/parent(s) reasonably consider may affect the child during the camp including special dietary requirements illness disabilities any social behavioural problems (e.g. ADHD or any equivalent or similar or any other affliction that may render the child Incompatible as defined above that a child currently has or has recently experienced or any other such personal and/or sensitive information. We consider this as Personal Information.
It is forbidden for participants to smoke, use drugs or drink alcohol during the camp. Should this occur, the participant(s) will be expelled from the camp with no refund.

7. MEDICAL
We request parents to notify all health issues, allergies or food intolerances. All information provided is the responsability of the parent and must be send to info@sportinc.be prior to the start of the camp. We suppose that all participants are in good health and good physical condition. All participants are supposed to be in order with all legal medical restrictions for vacinations.
All camps will  have a first aid kit on site. In an emergency, the parent/guardian will be contacted as soon as possible. If a contact is not possible, action will be taken without the parent/guardian’s agreement. On registrating your son or daughter you agree to Sportinc and the medical services associated taking the necessary medical decisions for the benefit of your child.  You authorise the local medical authorities to take the necessary decisions concerning your child’s health.

8. INSURANCE
All Belgian participants are covered by accident insurance for all day camps. For the residential camps, a further insurance has been contracted to cover accidents 24/24 hours. This insurance also covers participants from abroad. Should an accident occur during one of our activities, the parent of the injured child should request a form, from the head of camp, to declare the accident to the insurance company and handle the claim  thereafter. Sportinc declines all responsability in the case of late notification of a claim by the parent.
Mouth guards and shin guards are obligatory during all hockey activities, if this is not the case then the accident insurance may refuse to cover a claim.
During the camps participants not residential in Belgium must benefit from an assistance and repartriation insurance. The parents/guardians must notify the references of the policy which covers their child.
Sportinc accepts no responsibility for any sickness, pilferage, machinery breakdown, government restrains, acts of war/terrorism, weather conditions or for any misadventure or casualty or any other causes beyond their control. This is not limited to, but may include.

9. EQUIPMENT & BELONGINGS

9.1 In the case of any damage or deterioration or theft of equipment owned by Sportinc or any location host, the participant(s) will be held responsible.

9.2 Sportinc will not be held responsible for loss or theft of the personal belongings or equipment of the participants.
If anything is missing when your son or daughter leaves camp please let us know about it right away as there may still be time to find it before Camp closes down at the end of the season. Expensive and treasured items such as but not limited to jewellery, music players, designer clothes/shoes/trainers, etc., should not be brought to camp as they are often unnecessary and inappropriate on a sport camp .

10. NEGLIGENCE
We accept responsibility for personal injury and for loss and damage generally, but only if caused by the proven negligence of the company or its employees. We do not accept responsibility for events which are outside of our direct control. These include (but not exclusively) force majeure events such as strikes, bad weather, war, etc. and injury, loss or damage that may occur while we are using third parties or subcontractors such as transportation companies.

11. OFFSITE ACTIVITIES
Some of our camps include excursions and offsite activities. All our usual standards of care and supervision apply. All children may participate in off-site events unless we specifically receive written notification to the contrary from parents or guardians.

13. PHOTOGRAPHY
The copyright of all photography appearing in our brochures and advertising campaigns. No reproduction may be made without prior permission from the company.
Please inform Sportinc (info@sportinc.be) prior to the camp of your subscription if you do not want your child’s photograph taken. It may be used in future brochures.

14. PERSONAL DATA
Personal data will be treated confidentially. The personal data will be changed at the customer’s first request. The personal data will only be used within the contours of the activities of the camp.  GDPR-policy can be consulted on the website of Sportinc.

A translation of the current terms and conditions can be obtained at the first request of the customer.

15.COURT OF LAW
In case of litigation, the applicable court of law will be in Antwerp, section Antwerp, Belgium.
